It's All Over but for the Hard Work ( via Twitter)

In the past I have poured over the transcripts of The State of the Union speeches broadcasted the earlier night and broken down topic by topic ( I began during Bush's Second term and followed through) I realized the futility immediately. But alas it is a service needs to be practiced if only to point out how brazenly our political class twists, bends & contorts the details of the truth & the subserviant media's meme we are presented on such a regular basis.

Go figure this one out ... The case of Maksim Gelman's apprehension and arrest. 1st off let's set this up with full back story shall we?
Gelman was /is a piece of fecal matter who by the good grace of God was brought to the U.S. by his parents at the age of 5. His mother raised in him alone as the Father returned to his native country, the Ukraine* ( see commentary Less Fathers than Guns) Gelman attended schools in Brooklyn but managed to make himself such an annoyance to his peers, he made no friends or acquaintances that spoke highly of him throughout his childhood.
Gelman was an aggressive malcontent who being unable to establish any meaningful relationships fashioned himself as a graffiti artist & a crack cocaine user/dealer. This of course fueled his growing rage.

Between Febuary11 &12th 2011 Gelman went on a killing spree beginning with his mother's male acquaintance, the mother of the girl & the girl herself that he had an unrequited obsession with, & a person he mowed down in a vehicular homicide. Four other victims were attacked by Gelman before he was taken into custody & that is where our interest lays.

Our focus is on the last victim of Gelman's rampage, Joseph Lozito. He was attacked on a no#3 subway car heading uptown. In this same car was NYPD officers Tamara Taylor and Terance Howell, as they and the rest of the entire NYPD force where in the middle of a citywide manhunt for Gelman.

Gelman entered the traincar and headed straight the operators booth in which Howell and Taylor were. He demanded acces to the booth claiming that he was a cop! Officer Howell refused to open the booth door. Howell, in a grand jury testimony admitted he was frightened that Gelman may have had a gun and he and Officer Taylor remained in the booth for that reason.

Gelman then turned away and targeted Lozito stating "you are going to die!" stabbing the victim in the face with a kitchen knife. Lozito lunged at his attacker tackling him to the floor all the while Gelman stabbed repeatedly at the back of Lozito's head. Lozito had wrestled with Gelman to knock the knife away from his attacker. Only after Gelman was disarmed did Officer Howell step out of the booth to offer any assistance and then arrested the psycho.

Given all that, Lozito is in court leveling a suit against the City. What's the city's position? An NYPD legal representative states as such..."the police had no “special duty” to protect him or any individual on the train that day there’s a long-standing legal precedent requiring cops to put the public safety of all ahead of any one individual’s rights."

Yup you read that right- The Police department that doesn't want you carrying concealed firearms to provide your own protection & has taken an sworn oath, ."..to serve and protect its citizens" is not under any actual obligation to live up to the promise!

Here are some the precedent cases to support the city's argument

Castle Rock v. Gonzales, which found police employees had “qualified immunity” (legal land language that purports to shield individuals from personal responsibility) and thus could not be sued, after three kids were killed by the husband of a woman who’d three weeks prior gotten a restraining order that stipulated that he be at least 100 yards from her and their three daughters except during specified visitation time. This, despite four calls made by the woman to police, after the kids were snatched-up, including one in which she informed them of the location of the husband and their children.
Warren v. District of Columbia, in which two women heard their roommate being attacked downstairs by intruders called the police several times and were assured that officers were on the way. After their roommate’s screams stopped 30 minutes later they assumed the police were present and went downstairs, only to themselves be held captive, raped, robbed, beaten, forced to commit sexual acts upon each other, and made to submit to the sexual demands of their attackers, for the next 14-hours. The “officials” in legal land claimed that official police personnel and the government employing them owe no duty to victims of criminal acts and thus are not liable for a failure to provide adequate police protection.
Balistreri v. Pacifica Police Department, in which legal land “authorities” stated that police had no constitutional duty to protect people from crime, after a woman, who’d filed numerous complaints and had gotten restraining order, was continually harassed and had her property vandalized by her ex-husband.
DeShaney v. Winnebago County, which found that those who purport the right to steal money from others in the area to protect kids were not culpable after releasing a boy, into his father’s custody despite repeated evidence of abuse, including one bout that left him “profoundly retarded” and likely to spend the rest of his life institutionalized.

Where does President Obama think economic growth and job creation come from? In his State of the Union speech, he said “the true engine of America’s economic growth” was ”a rising, thriving middle class.” But that’s political rhetoric substituting for economic analysis. Ask most economists, even those working in the Obama White House, and they’ll tell you that innovation-driven productivity is the true engine of prosperity and rising living standards.
And where does Obama think innovation-driven productivity comes from? Judging from his speech, Obama apparently sees government at the prime catalyst and planner – whether its government creating manufacturing hubs or government mandating new rules to spur more energy efficiency or government offering tax credits to spur investment in favored sectors.
And the free enterprise system? Well, entrepreneurs only got a couple of brief shoutouts, once in relation to high-skill immigration. Here’s the other: “Now these initiatives in manufacturing, energy, infrastructure, housing, all these things will help entrepreneurs and small-business owners expand and create new jobs.”
Certainly entrepreneurs could use some help. Consider:
1. Had small business come out of the recession maintaining just the rate of start-ups generated in 2007, according to McKinsey, the US economy would today have almost 2.5 million more jobs than it does.
2. There were fewer new firms formed in 2010 and 2011 than during the Great Recession.
3. The rate of startup jobs during 2010 and 2011, years that were technically in full recovery, were the lowest on record, according to economist Tim Kane of the Hudson Institute.

American Culture- Less Fathers than Guns

Commentary
It is unfortunate that in such subject these days it is nessecary to place down preliminary qualifiers as to prevent persons of certain political leanings from over reading into subtext or twisting it into a pretzel to conflate what is actually being said to mean something aimed at injuring.

1) it is not my goal here to belittle single parent households- I was raised in one myself and I raised my son alone as well.
2) in this commentary generalizations will be made and for the sake of clarity and indeed, brevity, I am not going to add qualifiers to each time I mention a group of persons, classifications and/Or factions.

To start it is essential to take into account that despite declining overall crime rates and rising percentages of single parent families Poverty is the key cohesive factor between the two. Of those families 84% are led by single moms.


What can be wrought from the rise in single parent families is that poverty is almost a foregone conclusion Approximately 60 % of the children being raised in single parent households, 66 million, upwards of 16 million kids are growing up @/below poverty levels. Factors that tie in with poverty are typically subpar housing, crowded schools, lack of development in social and moral directions, and the higher likelihood of being involved in criminal behavior. Studies indicate that the longer a child is in poverty the less likely they will be capable of developing skills and ethics to reverse their situation.

Some hard statical data-
60% of the incarcerated population and 70% of Juvenile offenders grew up in single parent households
63% of youth suicides are of children from single parent households
85% of behavioral disorders are found to be from single parent households
71% of all high school drop outs are children of single parent families
87% of children raised in single parent families were likely to select
To raise their own children in the similar circumstances

If we were going to honestly address the majority of gun crime in this country - we would need to directly engage the fact that the ever growing population of single parented males are 3 times more likely to become involved in gang related criminal activities which accounts the vast majority of homicides by firearms. Until we cross that uncomfortable rubicon, no amount of political rhetoric or restrictive law is going to change the dynamics for the better.

Sweet! Maybe, just maybe, some people on the left can truly begin to realize and understand why the Tea Party and Conservatives are getting extremely worried about Drones Surveillance, Wireless Taps, and Gun Control/Confiscation. After the horrific shooting in an Aurora Co. Movie theater The Media essentially rushed begin stalking Conservatives to blame it on. Branco's cartoon at Legal Insurrection

Speaking of Gun Control

My personal irony meter has ticked up in the past several weeks as there has been an all push by the majority of media to address the need for tougher Gun Control laws. Several News organizations have now sought to publish maps, lists and names of registered firearms holders in their papers, stating that afterall it is a matter of public record and should be made readily available for the people.
The curious questions creep up in my mind why they did not find such diligence in reporting the Fast & Furious Gun walking program that supplied thousands of arms and ammunition to Narco drug lords in Mexico. Did they not spur multiple massacres of Mexican and U.S. Persons that number in the hundreds? The overall majority of the Media News Organizations could not muster even a solid investigative piece on it, yet they are compelled to harass legal registered gun owners who have not harmed anyone with their firearms, by attempting to shame them in a listing of of their names and address' I would go as far as declaring a modern day equivalent to scarlet lettering accept that the Gun Owners have not in any way shape or deed broken the law at all! ( please note I could further the argument by introducing the 9/11 Benghazi Massacre flawed coverage to this)

North Korea

The North Korean Regime has completed another underground nuclear test that registered a magnitude 5.1 by the U.S. Geological Survey. Higher than the previous two nuclear tests North Korea has preformed in the past. North Korea confirmed said test and has now escalated it's already aggressive posture to the Western powers particularly the U.S. And it's allie South Korea

The inside game we need to bare in mind on this subject is that much if not all of North Korea's nuclear program is being funded by The Nihilistic council of 12 Mullahs of Iran. Then consider the potential of intercontinental ballistic missiles in the hands of both of these dangerously unstable nations. There is an extremely dangerous policy in cutting defense budgets in the wake of such events but that is our policy. . . To fund unsustainable social programs over national defense obligations.
My only question is this... After a nuclear device goes off state side either delivered by missile, automotive vehicle, or a in a suitcase, will the poor of the area afflicted need more EBT cards or radiation treatment?

The former Enron accounting advisor admits in the long run the U.S. will need to resort to "death panels & Sales taxes" in determining who receives life sustaining health care and who doesn't - the targets of such will be the aged at first but history has told us where this monstrous thinking progress' to far too often. It begins with the aged and the terminal, it advances to mentally impaired or disabled then includes the physically handicapped not even to mention a policy that advances the pre birth screenings to abort the "defective" along with the plain old "a baby will ruin my social lifestyle" elected abortions. & just in case you are unaware of what a VAT tax is :

The Art Of Providing Cover

WASHINGTON — The U.S. military is determined to position small, quick reaction forces closer to global crises after the rapid assault on the U.S. diplomatic mission in Libya last September kept U.S. armed forces from responding in time to save four Americans.

This is an assessment made by the reporter based upon Thier understanding of the details in the Testimony of Panetta & Dempsy. What it does not account for is that a) two military options existed 2 CIA options at the time & of those options Only 2 were available to Panetta based upon his clearance to authorize- the 6 man rapid response team based in the Tripoli embassy (3hours out) & the assets at the CIA Annex 1 mile away from which Agents Dogherty & Woods arrived from after disregarding orders to "Stand Down" according to animonous CIA sources.

The Second Two options would have required POTUS approval since they were not located " in country". Those were the strike teams based on the Stennis carrier group and the team based in Italy, both capable being on sight well within the 7&1/2 hours that the consulate was under attack. As Panetta's testimony confirms no further communications with the POTUS occured after the initial meeting at the beginning of the attack. Why?

Furthermore, according to this testimony the POTUS issued a directive- to do whatever was nessesary to protect Ambassador Stevens and staff.
Again why was this directive clearly followed ?

Next, Panetta-
"Time, distance, the lack of an adequate warning, events that moved very quickly on the ground prevented a more immediate response,"

This is Quote from Panette requires willfull ignorance of the following facts a) multiple cables from the consulate security team and the Ambassdor himself, several weeks before the attack, of deteriating conditions on the ground. b) that the rapid response team stationed in the embassey, located in Tripoli could not reach the Consulate within 7 hours had they been ordered to so immediately as per the POTUS's directive c) & that Panetta himself testified that he issued orders for teams based Spain and Europe to prep for Benghazi knowing full well he would require the Presidents authorization to do so
d) & where exactly was the communication to receive that authorization? As we already mentioned- no further conversations occurred between the White House and Secretary of Defense's office.


Panetta said he and Dempsey were meeting with Obama when they first learned of the Libya assault. He said the president told them to deploy forces as quickly as possible.

While reported by the LA Times:
Defense Secretary Leon E. Panetta learned of the attack shortly after it began, about 4:30 p.m Eastern time, Defense officials said, and discussed it in a previously scheduled meeting with the president. Obama ordered him to pursue whatever options were feasible, a Defense official said.
Panetta "ordered all appropriate forces to respond to the unfolding events in Benghazi, but the attack was over before those forces could be employed," Pentagon spokesman George Little said.

All appropriate forces would mean "in country" forces in this circumstance.


During the eight-hour period, did he show any curiosity?" Graham asked.
Panetta said there was no question the president was concerned about American lives. Exasperated with Graham's interruptions, Panetta said forcefully, "The president is well-informed about what is going on; make no mistake about it."

Exactly how can Panetta say this without having any communications after their 5:30 meetings? He directly counterdicts his own testimony

Of course just as damning is the fact that not one single Major Broadcast Network ( ABC, CBS, NBC) bothered to report on the hearing at all.

Karl Rove- "It's MY Party & I'll Cry if I Want To"

Mr. Karl Rove & Stephen J. Law are none too happy with the base of the right wing these days. After having invested heavily in losing campaigns of CINO's ( conservatives in name only) candidates last November, Rove & Law, feel it is now nessecary to insure the Conservative base no longer gets to offer up individuals like Marco Rubio or Ted Cruz. Apparently they feel the politicians of the stock that Linda McMann or Scott Brown were are the last best hope for the slow dieing Grand Old Party. They seemed to have forgotten that it was the Conservatives who were out there in the streets & on the phones pushing/pulling/ imploring the candidates to finish the race.

It was the flawed thinking of moderate wing that put a leash on discussing Benghazi in the last weeks of the campaign, the sheepish establishment of the GOP that attempted to bury the narratives of POTUS's cover up on Fast & Furious corruption & conspiracy. The absolute refusal to discuss in any substantive the complete & utter lawlessness of the Imperial Presidency of Barrack Obama.

But so be it Mr. Rove, you are free to round up your league of shallower principled politicians that shall be working towards your ends while the Conservatives & Tea Party shall assemble a legion dedicated to the founding notions of the constitutional governance this nation is defined by. We shall meet you on the fields of public debate & discuss those values & We shall defeat you simpliy and thoroughly

UPDATE: Mark R Levin on his national radio program has taken a jackhammer to the meme Rove has build around his career. Levin establishes Rove's resume is padded to increase his stature in the Conservative Political movement that the Reagan Presidency ushered in. I Highly advise all to take a listen To Febuary 8th Marklevin Podcast the second hour in which Levin makes the case against Rove lock stock and barrel .

OutOfOrder reBoot

After several months of home renovations, moving, packing, unpacking, moving again ( thankfully not my own treasures of my personal antiquity) I think I shall have an opportunity to read & write blogs again on a more regular basis.

Much has occurred since I began my self imposed hiatus and the concepts of conservative political philosophy has been undertaking a deep look in the mirror of late. Re evaluating it's assumptions is the worst possible thing to happen. Granted it is not at all where any of us desired to be post Presidential election- but I believe we ALL recognized - we needed it long before the November election.

Thanx to all who have reached out to me to see if I was still alive & kicking . Your encouragement has aided my return.
